If work is stopped or put on hold at your request, or delayed through your default (e.g. non-supply of materials), we shall be entitled to payment for work already done and materials specially ordered.

No cancellation by yourselves of an order which has been accepted by us will be effective unless agreed in writing by us on terms that you shall indemnify us in full against all loss (including loss of profit) costs, (including the cost of all labour and materials used), damages, charges and expenses incurred by us as a result of cancellation.  We are not obliged to agree cancellations of order from goods mzanufactured or acquired specifically for you.

The complete quantity of a call-off order is manufactured at the same time; therefore you cannot exercise the right to change any detail to an order once we have processed it.

We make every effort to supply high quality products and to meet requested delivery dates.  However, we shall not be liable for any indirect losses arising through delayed delivery or the need to replace defective work.

Where the goods are for delivery by instalments any defect in any instalment shall not be a ground for cancellation of the remaining instalments and the buyer shall be bound to accept delivery of.

Tools, dies and drawings made for the manufacture of goods to be supplied to yourselves shall remain the property of West End Sourcing even though you may have been charged with a sum in respect of the cost of such, unless otherwise agreed in writing by West End Sourcing.

Your tool, fixtures etc are used at your risk and West End Sourcing cannot accept any claim for loss or damage to these. All such materials together with drawings, artwork, samples and whatever info is required from yourselves must be received in due time to avoid interference with other contracted work.  Prices and completion dates quoted are dependent on unimpeded progress and delivery of completed order.

All sales are subject to these conditions and any special terms given in writing by West End Sourcing, but excluding any and all printed terms of purchase proposed by you that are inconsistent with these conditions.

The contract to which these conditions relate cannot without West End Sourcing’s written consent be assigned or transferred to any other person.
